Please read these Terms of Service ("Terms") carefully before using the Faniverz mobile application or website (collectively, the "Service") operated by Faniverz ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

Some features of the Service require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with others
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

3. Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes. You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose
• Transmit viruses, malware, or any other malicious code
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the Service

4. User-Generated Content

4.1 Your Content

The Service may allow you to submit reviews, ratings, comments, watchlists, and other content ("User Content"). You retain ownership of your User Content but grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, display, and distribute it in connection with the Service.

4.2 Content Standards

You agree that your User Content will not:

• Be false, misleading, or defamatory
• Contain hate speech, harassment, or threats toward any individual or group
• Infringe the intellectual property rights of any third party
• Contain nudity, explicit sexual content, or graphic violence
• Constitute spam or unsolicited commercial communications
• Violate any applicable law or regulation

4.3 Moderation

We reserve the right (but have no obligation) to review, edit, or remove any User Content that violates these Terms or that we deem inappropriate, without notice.

5. Third-Party Content and Services

The Service displays information sourced from third-party databases, streaming platforms, and movie data providers. This content is provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of such information, and we are not responsible for errors or omissions in third-party data.

Streaming availability information is subject to change by the respective platforms at any time without notice to us.

6. Intellectual Property

All content, features, and functionality of the Service — including the logo, design, text, graphics, software, and code — are owned by Faniverz or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

Movie titles, posters, cast information, and related metadata are the property of their respective studios, distributors, and rights holders. Faniverz displays such content under applicable licences or fair use principles for informational purposes.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Streaming availability, release dates, and other time-sensitive information displayed on the Service are provided without warranty of accuracy and may not reflect real-time platform catalogues.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FANIVERZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) USD $10.

10. Indemnification

You agree to indemnify, defend, and hold harmless Faniverz and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, 10, and 13 of these Terms survive termination.

You may delete your account at any time through the account settings in the app.

12. Changes to the Service and Terms

We reserve the right to modify or discontinue the Service (or any part of it) at any time without notice. We may also update these Terms from time to time. We will notify you of material changes via the app or email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in the country in which Faniverz is incorporated, and you consent to personal jurisdiction in such courts.

14. Miscellaneous

• Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Faniverz regarding the Service.
• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.
• Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
